Terms and Conditions of Use and Sale

Article 1: Purpose

These General Terms and Conditions of Use and Sale (hereinafter "T&Cs") aim to define the terms of provision of the FredLooX platform (hereinafter "the Platform") and the conditions of use of the service by the User. The Platform is an intermediary service connecting bike owners (hereinafter "Owners") and individuals wishing to rent them (hereinafter "Renters"). FredLooX acts as an intermediary.

Article 2: Definitions

Within the meaning of these T&Cs, the following terms are defined as:

• Platform: Refers to the "fredloox.fr" website and its associated services.
• User: Any individual or legal entity registered on the Site, whether a Renter or Owner.
• Renter: Any User renting a bike via the Platform.
• Owner: Any User offering one or more bikes for rent on the Platform.
• Service: All intermediary, booking, payment, and management services provided by the Platform.

Article 3: Registration, Access, and User Account

Access to the Platform is free. To use the rental services, the User must create an account, be at least 18 years old, and have full legal capacity. The User agrees to provide accurate, complete information and to keep it up to date.

The User is solely responsible for the confidentiality of their password and the use of their account. They agree not to disclose it. Any connection or transaction made via their account will be deemed to have been made by them.

Article 4: General Obligations and Anti-Circumvention

The User agrees to use the Platform fairly and not to circumvent the FredLooX booking and payment system. It is strictly forbidden for Owners and Renters to use the Platform's messaging system to exchange personal contact information (phone number, email, etc.) with the aim of concluding a rental outside the Platform.

Any proven attempt or actual circumvention of FredLooX's services to avoid paying the service commission will result in the immediate suspension and potentially the permanent deletion of the concerned User's account, without notice or compensation.

Article 5: Owner's Obligations

The Owner agrees to:

• Provide accurate and complete information about the bike (description, photos, condition, price).
• Maintain the bike in perfect working order, cleanliness, and safety, in accordance with current regulations.
• Hold valid civil liability insurance.
• Honor confirmed bookings and make the bike available at the agreed-upon dates and times.
• Use the QR Code Check-in and Check-out system provided by the Platform to start and end the rental.
• Not abusively cancel confirmed bookings. In the event of a cancellation by the Owner, the Renter will be fully refunded all amounts paid.
• In case of non-return of the bike or observed damage, the Owner must report a dispute via the "Report an issue" button in their rental history within 24 hours of the scheduled rental end time. After this period, the guarantee (deposit) will be automatically released.

Article 6: Renter's Obligations

The Renter agrees to:

• Provide accurate identity information.
• Pay the total rental amount and insurance fee (if applicable) to confirm their booking.
• Use the rented bike as a "prudent person", with care, and in compliance with the Highway Code.
• Use the QR Code Check-in and Check-out system to start and end the rental.
• Take care of the equipment and return it in the same condition as at Check-in.
• Return the bike at the agreed-upon time and location.
• In case of theft, file a complaint with the authorities within 24 hours and immediately inform the Owner and FredLooX.
• Not to sublet the bike or lend it to a third party.
• In case of a no-show at the Check-in time, the rental is considered due. The Renter will not be entitled to any refund, and the booking will be automatically finalized after its end date.
• Failure to perform the Check-out at the scheduled time will be considered as non-return of the bike and will lead to the engagement of the guarantee (deposit or insurance) after an alert and review by the site administrator.

Article 7: Booking Process

The Renter submits a booking request via the Platform. If the Owner does not use "instant book", they have a period to accept or refuse the request. Upon acceptance (manual or instant), the Renter is prompted to pay.

Payment is made via the secure Stripe system. The booking is only confirmed after payment is received. If payment is not made within 24 hours of acceptance, the booking request expires.

Article 8: Financial Conditions

The prices displayed on the Platform are set by the Owners.

• Commission: FredLooX collects a service commission of 15% (fifteen percent) on the rental amount as well as on any amount charged from the security deposit (deposit, penalties, repairs) to cover management and transaction fees.
• Late Fees: Unless amicably agreed with the Owner, a grace period of 45 minutes is allowed for the return. Beyond that, late fees may be applied and charged to the guarantee, based on 150% of the applicable hourly rate per hour of delay.
• Owner Payout: Earnings (rental amount minus commission) are transferred to the Owner via Stripe after the effective end of the rental, provided no dispute is opened.

Refund for Early Return: For rentals longer than 24 hours, if the Renter performs the Check-out more than 24 hours before the scheduled end time, a 50% (fifty percent) refund for the unused full days will be automatically issued.

No-Show: If the Renter does not show up for Check-in and has not canceled their booking, no refund will be issued, and the Owner will receive their earnings.

Article 9: Cancellation

Cancellation policies are defined by the Owner and visible on each listing:

• Flexible: Full refund if cancellation occurs more than 24 hours before the rental starts.
• Moderate: Full refund if cancellation occurs more than 5 days before the rental starts.
• Strict: No refund if cancellation occurs within 7 days before the rental starts.

Service and insurance fees are non-refundable. If the Renter cancels within the refundable period, the refund is calculated on the rental price only.

In case of cancellation initiated by the Owner, the Renter is fully refunded (rental price and service/insurance fees).

Article 10: Guarantee System

To protect the Owner's equipment, each rental is subject to a guarantee, which takes one of two forms:

• 1. Deposit via Bank Card Hold (Stripe): The Owner sets a deposit amount. This amount is not debited from the Renter's account. A pre-authorization (bank hold) is placed 24 hours before the rental begins. This hold is automatically released 24 hours after the rental ends, unless the Owner reports a dispute (see Article 11).
• 2. Theft and Damage Insurance (Sharelock): For eligible bikes, the Renter can subscribe to optional insurance offered by our partner Sharelock. By choosing this option, the Renter pays the insurance cost, and no deposit hold is placed.
• By subscribing to the insurance, the Renter agrees that their personal data (name, email, rental details) will be transmitted to Sharelock to establish the insurance policy. In the event of a claim (theft or damage), the FredLooX dispute procedure (Article 11) applies, and the file is forwarded to Sharelock for compensation according to their contract terms.

Article 11: Dispute Management

In the event of damage, theft, or non-return of the bike, the Owner must report it via the "Report an issue" function on the Platform within 24 hours of the scheduled rental end time.

Reporting a dispute suspends the release of the deposit (if applicable) or initiates the claim process (if insured). The Renter is notified and invited to provide their version of events via the Platform's messaging system.

FredLooX administrators will act as arbitrators. Based on the evidence provided by both parties (descriptions, photos, messages), FredLooX will make a final decision, including the full or partial capture of the deposit. The decision of FredLooX is binding. In the event of a deduction from the deposit, a 15% dispute management fee will be deducted from the amount paid to the Owner.

Article 12: Role and Liability of FredLooX

FredLooX acts as a simple intermediary. FredLooX is not a party to the rental agreement concluded between the Owner and the Renter. Consequently, FredLooX cannot be held responsible for the actions or failures of either party, nor for the condition of the bikes, incidents, thefts, or damages occurring during the rental.

FredLooX strives to keep the Platform accessible 24/7 but cannot guarantee uninterrupted availability. FredLooX's liability cannot be engaged in case of service interruption, maintenance, bugs, or force majeure.

Article 13: Personal Data (GDPR)

FredLooX is committed to protecting its Users' personal data in accordance with the GDPR. Users are invited to consult our Privacy Policy, which is an integral part of these T&Cs.

This policy details the data collected, the purposes of processing, retention periods, recipients (including Stripe and Sharelock), and how Users can exercise their rights.

Article 14: Intellectual Property

The "FredLooX" brand, logos, site design, and all content (texts, images) created by the Platform are the exclusive property of FredLooX EI. Any reproduction, even partial, is prohibited without prior written authorization.

Article 15: Modification of T&Cs

FredLooX reserves the right to modify these T&Cs at any time. Users will be informed of any substantial changes by e-mail or via a banner on the site. Continued use of the Platform after a modification constitutes acceptance of the new T&Cs.

Article 16: Applicable Law and Jurisdiction

These T&Cs are subject to French law. In the event of a dispute, and after an attempt to find an amicable solution, exclusive jurisdiction is given to the competent courts of Pointe-à-Pitre.
